Waiver, release of liability, assumption of risk, and indemnification agreement, Five Star Exotic Cars Club.
This agreement applies to events organized, sponsored, or coordinated by Five Star Exotic Cars Club, Five Star Contracting, if applicable, and Moran Avraham, known as Ronnie.
1. Risks.
I understand that participating in exotic car events, organized drives, convoys, and related activities involves risks. These risks include, but are not limited to, traffic accidents, collisions with other vehicles or pedestrians, road hazards, weather conditions, mechanical failures, vehicle damage, property damage, personal injury, disability, and death. I understand that these events may involve driving on public or private roads and that other drivers, passengers, participants, or third parties may act negligently or unpredictably. I acknowledge that serious accidents and injuries may occur even when precautions are taken. I voluntarily choose to participate and accept these risks to the fullest extent permitted by law.
2. Assumption of Risk.
I knowingly and voluntarily assume the risks described above, including the risk of personal injury, death, or property damage.
3. Compliance with Laws and Event Rules.
I agree to comply with all applicable traffic laws, insurance requirements, seat belt laws, and reasonable safety instructions issued by event organizers. I understand that following event rules does not guarantee safety.
4. Driver Responsibilities.
Any person operating a vehicle agrees to maintain a valid driver’s license and required insurance, drive safely and legally, never drive recklessly or while impaired, ensure passengers use seat belts as required, exercise reasonable care for passengers, other participants, and the public, and accept responsibility for their own actions and omissions to the extent provided by law.
5. Release of Liability,
To the fullest extent permitted by New Jersey law, I release Five Star Exotic Cars Club, Five Star Exotic Cars LLC, Five Star Contracting if applicable, Moran Avraham known as Ronnie, and their respective owners, organizers, officers, employees, agents, volunteers, and representatives from claims that may legally be released, including claims related to accidents, injuries, and vehicle or property damage arising from my participation. This does not waive liability that cannot legally be waived.
6. Vehicle Damage and Insurance.
I understand that vehicle damage, personal injury, or property loss may occur. I am responsible for understanding my own insurance coverage, including exclusions, limits, and deductibles.
7. Indemnification.
To the fullest extent permitted by law, I agree to indemnify and hold harmless the released parties against third-party claims, reasonable expenses, and losses caused by my negligent, reckless, or intentional conduct, or breach of this agreement.
8. Driver and Passenger Signatures.
The driver must attach a copy or photograph of their driver’s license and sign below. If there is a passenger, the passenger must attach a copy or photograph of their driver’s license and sign below. Each adult signs for themselves only.
9. Future Events and No Fixed Expiration Date.
This agreement has no fixed expiration date and is intended to apply to future events organized, sponsored, or coordinated by the covered organizations to the extent legally effective.
10. Governing Law and Severability.
This agreement is intended to be governed by the laws of the State of New Jersey, subject to applicable legal requirements. If any provision is found invalid, the rest remains effective to the extent permitted by law.
11. Final Acknowledgment.
By signing, I confirm I have read and understood this agreement, understand the risks, and agree voluntarily.
12. Rental Vehicles, Private Vehicles, Drivers, Passengers, and Vehicle Owners
I understand that vehicles participating in Five Star Exotic Cars Club events may be rented, leased, borrowed, or privately owned. If I use a rental or leased vehicle, I am responsible for complying with my rental agreement and insurance. If I use a privately owned vehicle, I confirm I have the owner’s permission and appropriate insurance. To the fullest extent permitted by New Jersey law, I release Five Star Exotic Cars Club, Five Star Exotic Cars LLC, Five Star Contracting if applicable, Moran Avraham known as Ronnie, and their covered organizers from claims that may legally be released, including those involving accidents, injuries, and damage arising from participation. This applies to drivers and passengers, each of whom must sign separately.
13. Passengers who have not signed the waiver.
If a driver chooses to transport, pick up, or allow any passenger to ride in their vehicle in connection with any Five Star Exotic Cars Club event, the driver is responsible for ensuring that the passenger has been informed of the risks and has completed and signed the required waiver before participating. If the driver permits a passenger to ride without signing, the driver agrees that, to the fullest extent permitted by law, the driver assumes responsibility for claims, injuries, damages, or losses arising from their own acts or omissions, including claims involving injury or damage suffered by that passenger. The driver further agrees, to the fullest extent permitted by applicable law, to indemnify and hold harmless Five Star Exotic Cars Club, Five Star Exotic Cars LLC, Five Star Contracting if applicable, and Moran Avraham, known as Ronnie, from third-party claims to the extent those claims result from the driver’s conduct, negligence, or breach of this agreement.
